Brad-Davis-Marine-veteranMarine veteran Brad Davis, 34, plead guilty to killing his stepfather after giving him an “atomic wedgie” following an argument on December 2, 2013.

According to Mirror, Davis performed the childish stunt after Denver St Clair, 58, “jumped him” after a night of drinking in their Oklahoma home.

Davis’ plea reduced his first-degree murder charge to the less severe manslaughter charge. He will now face up to 35 years in prison. According to the court affidavit, Davis “grabbed St Clair’s underwear and gave him an atomic wedgie.”

“Davis allegedly pulled the elastic waistband of St Clair’s underwear over his head and around his neck.”

Amy Elliot, the spokeswoman for the Oklahoma Medical Examiner, said St Clair died from “asphyxiation and blunt force trauma after the elastic band was stretched too tightly over St Clair’s neck.” There were also traces of blood found in the kitchen, living room and on the ceiling.

Davis claims the altercation started when St Clair began verbally attacking his ex-wife, and Davis’ mother, Tressia.

“I’d never seen this before, but when we first looked at our victim seeing the waistband of his underwear was around his neck,” said Pottawatomie County Sheriff Mike Booth.

Even though Davis claims to have acted in self-defense, the death was ruled a homicide. During the time, St Clair was under a permanent protective order filed in 2008 by Tressia.

Tressia claims to have found St Clair embracing in a “sexual way” a drinking partner of his and that later he “grabbed her by the neck and threw her through a bathroom door.” She filed for divorce in 2010, but the divorce was dismissed; St Clair filed for a divorce last year.

Davis is set to be sentenced in July by a district judge.
